Terms of Service
Silverquest (we/us/the company) runs the game and website at silverquest.com, plus anything related to those services. Read through these terms carefully. When you use our services, you're saying you agree to them. If you don't agree, don't use the services or any of their content. We can change these terms whenever we want, and if you keep using the services after we do, that means you've accepted the new version. New features added to the services fall under these same terms unless we say otherwise. Check back here once in a while to see if anything's changed.
GAMING & CONDUCT RULES
We built these services on community, fairness, integrity and engagement. Follow the rules and you'll have a good time. This part covers how to set up accounts, what in-game features work like, and what you can't do. User Accounts. You get one account per platform or device. We'd suggest keeping just one account across everything, honestly. If you decide to run multiple accounts on different devices, they can't interact with each other at all. If we catch them interacting, we might ban, reset, or otherwise penalize one or more of those accounts. Virtual Goods Transfers & Account Sales. Anything from the game—virtual currencies, in-game items, the whole thing—can't be sold, traded, or converted to real money. Try it and you're breaking the terms. That could mean a permanent ban or legal trouble. Sales of virtual goods and currencies are final. No refunds, no exceptions. Virtual stuff can't be turned into actual money. We have complete control to manage, change, modify, or get rid of virtual currencies and goods however we see fit. We won't be responsible to you or anyone else if we do. You're responsible for every charge on your account, whether you made it or someone else who got access to your account did. Lose your account to termination or suspension for any reason, and you lose all virtual goods and currencies with it. General Conduct & Prohibited Acts. Some things just aren't allowed. You can't: Use the games if you're under 13. Pick a character name that disrespects other players. Run bots, auto-clickers, hacks, or exploits in the games or do anything else our rules prohibit. Tell other players through our channels that they're cheating. This means forums, profile walls, status messages, and chat. If you genuinely think someone's cheating and have solid proof, contact us directly through our form instead. Upload, post, email, transmit, or share anything on the services that's unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, pornographic, sexually explicit, libelous, invasive of privacy, hateful, racially or ethnically objectionable, promotes crime, creates legal liability, breaks any law, or is just objectionable in general. Anything that infringes on anyone's intellectual property, privacy, or publicity rights. Material you don't have the right to share. False statements, misrepresentations, or stuff designed to mislead or deceive. This includes impersonating someone else or our staff, or anything that could hurt minors. Mess with the services, their security features, servers, or connected networks. Don't break the rules, procedures, policies, or regulations of those networks. Don't probe, scan, test vulnerabilities, breach security, or get around authentication. Break any local, state, national, or international law or regulation, on purpose or by accident. Resell the services or access to them or their content. Do anything else these terms say not to. Action by Company. If you do any of the above, we might delete your post, thread, or chat message. Your account could be limited, blocked, suspended, or terminated temporarily or permanently depending on how serious it was. We might take other action we think is right. Availability. We can change, pause, or shut down the services whenever we want for any reason, no warning required. The services might be down sometimes for maintenance or technical issues. We can add to or update information and materials on the services without telling you. We can change and update the games whenever we decide it's necessary.
INTELLECTUAL PROPERTY, OWNERSHIP AND CONTENT RULES
We take intellectual property seriously and we protect it. This section explains who owns what and how content works. Copyright and Trademark Information. The services, their information, and materials belong to us and our licensors. Copyright law, trademark law, international agreements, and other IP laws protect them from being copied or spread without permission. Our product names and logos are our trademarks or registered trademarks. Other company and product names and logos belong to their owners in certain countries. Nothing on the services should be read as giving you any license or right to use the services or any materials on them through framing or any other method, unless we've given you written permission first. Feedback & Suggestions. If you send us suggestions, comments, or feedback, we can use it in the services or any other products we make. You're saying that we're not bound by confidentiality about your feedback, it's not confidential or proprietary to you or anyone else, you have the rights to give it to us, we can freely use it however we want including reproducing it, sharing it, licensing it, distributing it, and commercializing it, and you won't get paid or reimbursed for it. Content. Any information, data, messages, or other materials posted publicly or sent privately to the services is the responsibility of whoever posted it. We don't control that content, so we can't promise it's accurate, complete, or quality. Users understand that they might see offensive, indecent, or objectionable stuff when using the services. Partner Terms of Service. We follow the terms of service from our platform partners like Steam, Epic Games Store, GOG, and other digital platforms. You've read and agreed to follow the terms from whichever platform you're using to access us. Know what their terms say and don't break them because it could get you banned.
LIABILITY AND RISK TERMS
To offer these services, we have to limit what we're liable for. Here's how that works. Release. We don't supervise or control how members interact with each other or other people and companies. We don't control payment processors. We can't verify who people really are or how old they are. We have almost no control over the quality, safety, morality, legality, truthfulness, or accuracy of different parts of the services. So you agree you take all the risk. You release us from claims, demands, and damages that come from your use of the services or any third-party transactions. You also give up any rights you'd otherwise have under any law in any jurisdiction that would limit what a release or waiver can cover. DISCLAIMER. Everything on the services is provided as is. We don't claim, promise, or guarantee that the information and materials are correct, accurate, reliable, or complete. We don't promise the functions will run without interruption or errors. We don't promise defects will be fixed or that the services or servers are free of viruses or harmful stuff. We specifically disclaim all claims, promises, and guarantees, whether express, implied, statutory, or from trade practice or dealing, including any implied promises of merchantability, non-infringement, title, satisfactory quality, or fitness for a particular purpose. Anything you download or get through the services is at your own risk and responsibility. You're liable for any damage to your computer, data loss, or other loss from downloading or using any material. We don't promise, endorse, guarantee, or take responsibility for any content or materials on the services. We don't guarantee any products or services advertised by third parties through the services. We're not responsible for services you can reach through links on the services or featured in banners or ads. We're not a party to any deal you make with a third party through the services. LIMITATION OF LIABILITY. To the fullest extent the law allows, we won't be liable for any indirect, incidental, special, consequential, exemplary, or other damages. This covers damages from your use or inability to use the services or any information on them, the cost of replacement goods or data or services, errors or mistakes in materials on the services, property damage from using the services, bugs or viruses or trojan horses or other harmful files transmitted through the services, or any other loss or damage from using the services. These limits apply even if we knew damages were possible. These limits apply to the fullest extent the law allows in your jurisdiction. INDEMNIFICATION. You'll defend and hold us harmless. That means you, us, our affiliates, officers, agents, platform partners, and employees won't face claims, threats, actions, proceedings, demands, damages, losses, obligations, costs, or expenses including legal fees from any third party. This applies when those claims come from materials you posted or transmitted through the services, any way you broke these terms, or any way you violated someone else's rights including intellectual property, publicity, personality, or privacy rights.
GENERAL TERMS
A few other things you should know about using the services. Links to Third-Party Services. The services might link to other sites we don't own or run. We're not responsible for what's on those linked services. Any third-party services are under their own terms and conditions, and you're responsible for reading and following them. Termination. We can shut off your access to the services or parts of them right away without warning if we need to. Reasons include breaking these terms or any other agreement with us, requests from law enforcement or government, your own request, if we change or stop offering the services, unexpected technical or security or legal problems, or if you're involved in fraud or illegal stuff directly or indirectly. Terminating your access might also mean removing materials you uploaded. You understand we can terminate whenever we decide to and we're not liable to you or anyone else for doing it. If your account gets terminated or canceled by you or by us, you won't get a refund and you lose access to everything. Any termination by us is on top of any other rights we have. Security. Information over the internet isn't generally secure. We don't promise anything about security of communications to or from the website or about whether third parties might intercept personal or other information. Updates. We can change, pause, or shut down the services or their content or any part whenever we want, with or without notice. You agree we won't be liable for any changes, pauses, or shutdowns. Entire Agreement. These terms plus our privacy policy and rules and policies make up the whole agreement about the services.
